What this site tracks

This site tracks inter partes review activity at the Patent Trial and Appeal Board of the United States Patent and Trademark Office. It also tracks ex parte reexamination filings, orders, and certificate timing. The trend data covers 315(b) timing, 325(d) overlap arguments, fees, settlement windows, and institution outcomes since October 20, 2025, when the USPTO Director began deciding institution. This site updates its figures by hand after the USPTO publishes a new monthly PTAB trial statistics report or a quarterly reexamination operational statistics report.

How to read these numbers

The USPTO reports institution rates two ways. By petition: each petition decided at the institution stage counts once: instituted ÷ (instituted + denied). By patent: a patent counts as instituted if any petition against it was instituted, including in an earlier fiscal year, so the by-patent rate is always higher (USPTO method note, fiscal year 2019 roundup appendix). Compare fiscal year 2026 rates with the fiscal year 2024 and 2025 baselines only when both use the same method. Sources: the monthly PTAB trial statistics and the quarterly trial outcome roundups. The reexamination total combines two series. The first is the Central Reexamination Unit annual filing series through fiscal year 2025 (Ex Parte Reexamination Filing Data, September 30, 2025). The second is fiscal year 2026, October 1, 2025 to September 30, 2026 (Reexamination Operational Statistics). The petition total counts America Invents Act trials: inter partes review and post-grant review.
