Data insight1 min readInter partes review · Post-grant review

Fewer inter partes reviews are ending in settlement.

Settlements were 16% of concluded Patent Trial and Appeal Board trials in Fiscal Year 2026, down from 26% the year before, and fell in number from 368 to 198. The share counts institution denials in its denominator, so read the drop with care.

What the drop proves

The tempting reading

Parties are far less willing to settle IPRs.

Part 3 of 3

What it means

  • Expect fewer cases to end in a deal. Plan the budget through institution and, if granted, to a final decision.
  • If you do settle, list every side agreement the settlement refers to. Each one may have to be filed.

The takeaway

Settle on purpose, not by default. And file the side agreements.

Changes (4)
  • FY2025 kept at 26%, as in the original: the USPTO’s slide shows 26% for FY2025 and 27% for FY2022 (Trial Statistics, Aug and Sept 2026, slide 10; FY2025 end-of-year roundup, slide 9). A draft correction to 27% had the years reversed (Glossy re-check, Oct 16, 2026).
  • Added the denominator the original said was unspecified (Muse): settlements divided by concluded proceedings, which include denied institution, settlement, dismissal, requested adverse judgment and final written decision, excluding joined cases.
  • Added the settlement counts from the same slide (368 in FY2025, 198 in FY2026) and the five-year series for context.
  • Internal file path removed.
